Definitions
For purposes of these Terms and Conditions and any Service Agreement, the following definitions apply:
"Agreement" means these Terms and Conditions together with any written estimate, work order, or service agreement.
"Authorized User" means you or any person you authorize to make decisions regarding your Vehicle and Services.
"Business Days" means Monday through Friday, excluding federal and Montana state holidays.
"Company," "we," "us," or "our" means Moreno Mobile Mechanic.
"Customer," "you," or "your" means the vehicle owner or authorized agent requesting Services.
"Diagnostic Fee" means the charge for inspecting and diagnosing vehicle issues.
"Estimate" means a written or verbal approximation of the cost of Services based on initial inspection.
"Services" means any automotive repair, maintenance, diagnostic, or other services provided by the Company.
"Vehicle" means the automobile, truck, or other motor vehicle serviced under this Agreement.
"Work Order" means the document describing specific Services to be performed on your Vehicle.
Acceptance of Terms
Welcome to the Moreno Mobile Mechanic website. Moreno Mobile Mechanic provides this website and mobile mechanic services subject to these Terms and Conditions. By accessing or using this website, or by engaging our services, you agree to be bound by these Terms.

Services
Service Description
We provide mobile mechanic services throughout the East Helena area and surrounding communities. Our services include vehicle diagnostics, preventive maintenance, vehicle repairs, emergency roadside assistance, and other automotive services as agreed upon between you and our technicians.
Service Authorization
By requesting our services, you authorize us to perform the services described in any estimate or work order provided. Additional services discovered during the repair process may be performed upon your written or verbal authorization. You agree to pay for all services that you have approved.
Estimates and Final Invoicing
Estimates are preliminary assessments based on initial inspection and available information. Estimates are not guaranteed prices and are subject to change based on actual conditions discovered during service. Final invoice amounts may vary from estimates due to the discovery of additional issues during service, the actual time required for repairs, parts price variations, or complications not visible during initial assessment.
We will make reasonable efforts to notify you if work significantly exceeds the original estimate. You are responsible for the actual cost of repairs as reflected in the final invoice. By authorizing service, you acknowledge and accept that the final invoice may differ from the estimate provided.
Parts and Materials
We may use new, remanufactured, or quality used parts as appropriate for your vehicle and repair needs. Parts warranties are provided by the manufacturer, not Moreno Mobile Mechanic. Any parts supplied by the customer are installed at the customer's risk with no warranty provided by us on customer-supplied parts. We reserve the right to refuse installation of customer-supplied parts if we determine they are inappropriate or unsafe for the intended repair.
Mobile Service Area
We provide services within a reasonable radius of East Helena, MT. Additional travel fees may apply for locations beyond our standard service area. Service availability is subject to weather and road conditions. We reserve the right to cancel or reschedule appointments due to unsafe travel conditions.
Customer Responsibilities
Accurate Information
You agree to provide accurate and complete information about your vehicle, including make, model, year, and VIN. You must disclose any known issues or symptoms, previous repairs or modifications, and current contact information for service updates. Failure to provide accurate information may result in additional charges or inability to complete repairs.
Vehicle Access
You must provide a safe, accessible location for service with adequate space for our technician to work. Your vehicle must have sufficient fuel for testing and diagnostic procedures. Personal items should be removed from work areas, and any aftermarket alarms or security systems must be disabled before service begins.
Authorization
You warrant that you own the Vehicle or have full authority to authorize Services on behalf of the owner. You agree to be available by phone during service for any necessary approvals or consultations. Additional work discovered during service requires explicit authorization before proceeding.
Payment Responsibility
You are responsible for payment regardless of insurance coverage or warranty claims. Insurance claims are between you and your insurance provider. While we may assist with documentation, we are not responsible for claim approval or payment by third parties.

Permitted Use
This website is provided for informational purposes and to facilitate service requests. You may not use this website for any unlawful purpose or in violation of these Terms. Any unauthorized use may result in termination of access and legal action.
Intellectual Property
All content on this website, including text, graphics, logos, and images, is the property of Moreno Mobile Mechanic and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
Payment Terms
Payment Due
Payment is due in full upon completion of services unless otherwise agreed in writing. We accept cash, check, and major credit cards. All payments are processed securely through our payment systems.
Late Payment
A service charge of 1.5% per month (18% annually) applies to unpaid balances over 30 days. We reserve the right to require a deposit for parts or services, particularly for expensive repairs or special-order parts.
Storage Fees
Vehicles not picked up within three days of notification of completion will incur a storage and administrative fee of $75 per day. After 30 days, vehicles may be considered abandoned and subject to disposal under Montana law.
Payment Processing and Data Security
Credit Card Processing
We accept credit card payments through secure third-party payment processor Zoho Payments. By providing payment information, you authorize us to charge your payment method for all fees incurred. You represent that you are authorized to use the payment method provided.
Payment Security
We do not store credit card numbers or sensitive payment information on our systems. All payment processing is handled by PCI-compliant third-party processors using industry-standard encryption for all payment transactions. You acknowledge that we are not responsible for the security practices of third-party payment processors, though we only work with reputable, certified providers.
Chargebacks and Disputes
In the event of a payment dispute or chargeback, you agree to cooperate with our investigation. Fraudulent chargebacks may result in legal action and collection proceedings. You remain responsible for all authorized charges regardless of payment disputes.
Payment Information Updates
You are responsible for keeping your payment information current and accurate. Failed payments due to outdated information may result in service delays or additional fees.
Warranties and Disclaimers
Service Warranty
Moreno Mobile Mechanic warrants that all services will be performed in a good and workmanlike manner consistent with industry standards. This warranty covers our labor only and does not extend to parts or pre-existing conditions.
Disclaimer of Other Warranties
Except as expressly stated herein, we make no other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose. We do not warrant that repairs will resolve all vehicle issues or that your vehicle will perform to any particular standard after service.
Website Disclaimer
The website is provided "as is" without warranty of any kind. We do not guarantee uninterrupted or error-free operation of the website or online booking systems.
Limitation of Liability
To the fullest extent permitted by law, our liability for any claim arising from our services shall be limited to the amount paid for the work performed. In no event shall we be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of use of your vehicle, rental car costs, or lost wages.
Lien Rights
You acknowledge that we have a possessory lien on your vehicle for unpaid services pursuant to Montana Code § 71-3-1201, et seq. We may retain possession of the vehicle and personal property as allowed by law until all charges are paid in full. If payment is not received within a reasonable period, the vehicle may be subject to sale or disposal under applicable law.
Insurance and Risk Allocation
Company Insurance
Moreno Mobile Mechanic maintains appropriate commercial general liability and automotive garage liability insurance for the protection of our customers and business operations.
Customer Property
We are not responsible for loss or damage to personal property left in vehicles. We are not liable for pre-existing damage to your Vehicle. Our liability for property damage is limited to damage directly caused by our negligence during the provision of services.
Test Drives and Vehicle Operation
Test drives may be necessary for diagnosis and quality assurance. By authorizing service, you authorize us to operate your Vehicle for service-related purposes. We will exercise reasonable care during all vehicle operations and limit driving to what is necessary for proper diagnosis and repair verification.
Environmental Compliance
Hazardous Materials
We handle and dispose of all automotive fluids, parts, and materials in accordance with Montana environmental regulations and EPA guidelines.
Disposal Fees
You may be charged environmental disposal fees for used oil, coolant, and other fluids; batteries, tires, and other regulated materials; and hazardous waste disposal as required by law. These fees reflect our actual costs for proper disposal and environmental compliance.
Customer Materials
We are not responsible for disposal of customer-supplied parts or materials unless agreed in writing. Any special disposal requirements must be discussed before service begins.
Indemnification
You agree to indemnify and hold harmless Moreno Mobile Mechanic, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these Terms, provision of false or misleading information, or unauthorized use of your vehicle by third parties.
Privacy and Data Protection
Information Collection
We collect and use customer information solely for providing requested Services, communication regarding your Vehicle, legal compliance and record keeping, service history maintenance, and processing payments.
Information Security
We maintain reasonable security measures to protect your information from unauthorized access or disclosure. Vehicle service records are retained for seven years per Montana law. Payment information is processed through secure third-party processors, and we do not sell or share customer information with third parties except as required by law.
Communication
By providing contact information, you consent to receive service-related communications via phone, text, or email. These communications may include appointment reminders, service updates, and completion notifications.

Cancellation and Rescheduling
Booking Policy
Appointments may be booked up to two days before the desired service date through our website or via email link. We strive to accommodate urgent requests when possible.
Customer Cancellation and Rescheduling
Customers must cancel or reschedule appointments at least three days before the scheduled service date. No fees apply for cancellations or rescheduling made within the required timeframe. Cancellations or rescheduling requests made less than three days before the appointment may result in forfeiture of the appointment slot.
Company Right to Cancel
We reserve the right to cancel or reschedule services due to unsafe working conditions, threatening or abusive behavior, discovery of issues beyond our mobile service capabilities, or force majeure events. We will make reasonable efforts to notify you promptly of any cancellations.
Dispute Resolution
Good Faith Resolution
Before initiating legal action, parties agree to attempt resolution through direct communication between Customer and Company management. Any disputes should be documented in writing with reasonable opportunity for resolution within 30 days.
Mediation
If good faith efforts fail, parties may agree to non-binding mediation in Lewis and Clark County, Montana, with costs shared equally between the parties.
Governing Law and Venue
These Terms shall be governed by and interpreted in accordance with the laws of the State of Montana, without regard to conflict-of-law principles. Venue for any legal proceedings shall lie exclusively in the state or federal courts located in Montana.
Attorney's Fees
If legal action is required to recover unpaid amounts, you agree to pay all costs of collection, including reasonable attorney fees and court costs. If you initiate a claim against Moreno Mobile Mechanic that is resolved in our favor, you shall reimburse all reasonable costs of defense, including attorney fees, court costs, and expert witness fees.
Force Majeure
Neither party shall be liable for any delay or failure to perform due to causes beyond reasonable control, including but not limited to acts of God, natural disasters, severe weather, government actions or regulations, labor disputes or shortages, supply chain disruptions affecting parts availability, pandemic or health emergencies, or war, terrorism, or civil unrest. In such events, performance timelines will be extended accordingly, and we will communicate with affected customers promptly.
Termination
Termination by Customer
You may terminate Services at any time by paying for all work completed to date, parts ordered specifically for your Vehicle, and applicable diagnostic or service call fees.
Termination by the Company
We may terminate Services immediately if you fail to make required payments, provide false information, create safety concerns, or violate these Terms.
Effect of Termination
Upon termination, all outstanding amounts become immediately due. Our lien rights remain in effect for unpaid amounts. You must retrieve your Vehicle within three days, or storage fees apply as stated above.
General Provisions
Entire Agreement
These Terms, along with any service agreements or work orders, constitute the entire agreement between you and Moreno Mobile Mechanic.
Modifications
We reserve the right to modify these Terms at any time. Continued use of our website or services after changes constitutes acceptance of the modified Terms. Material changes will be posted on our website with notice of the update.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remainder shall remain in full force and effect.
No Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Service Agreement
Moreno LLC, dba Moreno Mobile Mechanic (“Service Provider”) and the Customer hereby agree as follows:
Scope of Work
The Customer authorizes the Service Provider to perform the services described in the attached estimate or work order, including diagnostics, maintenance, and repairs to the vehicle described therein. Additional services may be agreed upon by written or verbal authorization from the Customer. Any additional work authorized by the Customer will be performed and billed accordingly. The Customer agrees to pay for all such approved additional services.
Changes to Estimate
The Service Provider will give an estimate based on the information available to them, their experience, and expertise. The Customer hereby acknowledges that estimates for this kind of work can be higher or lower than the actual cost incurred and agrees that the Customer will be responsible for the actual cost of repairs. Service Provider will make reasonable efforts to notify the Customer if the required work significantly exceeds the scope of the original estimate.
Payment Terms
Payment is due in full upon completion of services, unless otherwise agreed in writing. A service charge of 1.5% per month (18% annually) will apply to unpaid balances over 30 days. The Service Provider reserves the right to require a deposit for parts or services. Accepted payment methods include cash, check, and major credit cards. Vehicles not picked up within three days of notification of completion will incur a $75 a day storage/administrative fee.
Warranties and Liability
Moreno LLC warrants that all services will be performed in a good and workmanlike manner consistent with industry standards. No other warranties, express or implied, are made, including any implied warranties of merchantability or fitness for a particular purpose, unless expressly stated in writing. Service Provider’s liability will be limited to the amount paid for the work performed to the extent allowed by law.
Lien Rights
The Customer acknowledges that the Service Provider has a possessory lien on the vehicle for unpaid services pursuant to Montana Code § 71-3-1201, et. seq. The Service Provider may retain possession of the vehicle and personal property as allowed by law until all charges are paid in full. If payment is not received within a reasonable period, the vehicle may be subject to sale or disposal under applicable law.
Effective Date
This agreement is effective when signed by the Customer or when work begins on the vehicle, whichever is sooner.
General Provisions
Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Montana, without regard to conflict-of-law principles. Venue for any legal proceedings shall lie exclusively in the state or federal courts located in Montana.
Attorney’s Fees and Collection
In the event legal action is required to recover unpaid amounts due under this Agreement, the Customer agrees to pay all costs of collection, including reasonable attorney fees and court costs. If the Customer initiates a claim against Moreno LLC that is resolved in the Service Provider’s favor, the Customer shall reimburse all reasonable costs of defense, including but not limited to attorney fees, court costs, and expert witness fees.
Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.
